CRIMINAL DEFENSE:
As a Public Defender and in private practice, KIM STEVEN LAVALLEY has handled a wide variety of serious criminal proceedings from petty theft to murder, and worked extensively defending small and large scale marijuana and drug possession charges, and “cultivation/for sale/distribution” cases in several counties, including the so-called “Emerald Triangle. “
- Successfully defended the sole man charged with what still stands as the largest cultivation operation in history in Shasta County (resolved as a no-time—no-fine misdemeanor) and successfully defended a man charged with large scale marijuana smuggling at the federal level (full dismissal.) And he also successfully defeated the vessel forfeiture action filed by the government.
In private practice, he has defended clients involving a wide spectrum of criminal investigations, ranging from early intervention in a vehicular manslaughter investigation resolved as a no-time served “reckless driving” charge, an attempted murder charge resolved as a simple assault, and other investigations and proceedings resolved in a most satisfactory manner.
Early on as a public defender, Kim LaValley initially specialized in Juvenile Law. While the laws and rules that apply to juveniles charged with criminal acts are in ways similar to those applying to adults, the procedures and desired goals can be quite different, and require a “parental” perspective to be successful and not unduly burdensome on both the juvenile and the custodial parent(s) or guardian(s).
- Kim has four grown children himself. He was very active in the adoption and foster child community in Humboldt County and understands the serious and troubling aspects of family law where a child’s behavior involves the family with governmental agencies, be it law enforcement or child welfare. He also represents parents in proceedings brought by Child Welfare (Protective) Services.
ADMINISTRATIVE LICENSE PROCEEDINGS and INVESTIGATIONS:
Kim LaValley has represented state license holders before administrative tribunals in license revocation and suspension proceedings, and local code violation charges before the local officials and state boards.
